Dr Gabriele would have talked to you about the serious threat of slum
evictions in Chennai and displacements to far off places affecting the
livelihood and educational rights of SC ( 70 - 80%) - and ST - MBC
people who are unorganised sector workers living on riverbank and
coastal areas.Herewith am forwarding the letter to jaipal Reddy and
some more details as attachments.
I'll shortly forward the scanned copy of the letter to National
commission of SC and it is our fervent request to you to meet them and
make them do immediate enquiry and stop evictions which would start in
1 week since schools would close.

Dear Sir/ Madam
Today 16.12.09 Wednesday, from 11 am near Chennai Memorial Hall, a
Protest Demonstration was organised by the Unorganised Workers
Federation, National Alliance of People's Movements together with
affected people and their unions. This protest is with regard to the
right to life and Livelihood, Education, Housing, of the Unorganised
Sector Workers and to bring to the public notice and kind attention
of the Government on the under mentioned issues.
In the last two months, due to the Port - Maduravayal Elevated Express
High Way Project, thousands of families of Unorganised Sector Workers,
belonging to Scheduled Caste and some Backward and Tribal Communities
of Chennai City, living in Slums Areas have been displaced to far away
places. They have been forcibly evicted during the monsoon and
displaced to Semmencherri, Kannagi Nagar, Okkiyam Thuraipakkam 35 kms
away from the city. The State Government has stated the 12 thousand
families would be displaced due to the Port - Maduravayal Project.
Fifty thousand people are all working in the neighborhood areas in
city in Construction, Domestic Work, Street Vendors, Basket Weaving,
Rickshaw, Driving etc and children studying in the neighborhood
schools were sent to outside city affecting Livelihoods and children's
Education, thus leading to the violation of Right to life and
Livelihood.
Similarly, in the name of Coastal Elevated Highway
Cleaning Project of 6 water ways in Chennai City, more than 3 lakh
Slum residents would be displaced to the far away places, thus
resulting in the denial of Right to life Livelihood and Education.
They have not been given the statutory notice but orally
informed in the previous evening and were told by Tamil Nadu Slum
Clearance Board officers and Police that if token is refused, they
would face demolition without alternate Housing. Thus people were
threatened and areas were demolished. Those who opposed were brutally
beaten up by the police and were also forced to attempt suicide.
All these eviction areas are notified areas under the
Tamilnadu Slum Areas Act 1971 and as per the provisions of the Tamil
Nadu Slum Areas Act 1971, have to be improved and houses should be
built in the same areas. Evicting them to outside the city is in
violation of the Tamilnadu Slum Areas Act and depriving them of
livelihood and Education. These areas are supposed to be developed
into commercial Complexes and Parks and Elevated Express Way, denying
the livelihoods of jobs of thousands of Unorganised Labourers and
Education of their Children.
JNNURM Violations
The Government of India Urban Development Ministry has
also stated the policy of In situ Slum Development and that is also
violated by these unjust evictions.
According to the Central Government Plan, funds were
provided for facilitating the slum development but have been used for
displacing slum people. The City development Plan for Chennai was
prepared by the State Govt. without public consultation. After
representations to Govt. of India, Ministry for Urban Development,
instead of the old CDP a new one is being evolved. While this is in
process, the State Govt. is resorting to slum evictions, riverside,
coastal and roadside, affecting over 72 thousand families, as
mentioned in the old CDP,
Action 2007, National Alliance of People's movements, while
protesting in New Delhi were assured by the Union Ministers for Urban
Development and Urban Poverty Alleviation Sri Jaipal Reddy and Kumari
Sailja that Slum areas would not be evicted for infrastructure
development and Slum areas would be developed in the concerned areas
only.
The outstanding issues regarding Maduravayal - Port Elevated Express
Way Project :
a. There was no Public Consultation.
b. This Project is in violation of Coastal Regulation Zone
notification and in this connection, the guidelines of Union Ministry
of Environment have been ignored by NHAI and Chennai Port.
c. We learn that lack of technical feasibility has been indicated by
the soil tests.
d. The 9km distance covered by PH Road has been made into Elevated
Express Way for 19kms. with many Hairpin Bends, violating norms for a
Highway Project.
e. It is very difficult to traverse Highway with Hairpin Bends by
heavy container trucks. It is apparent that it has been designed to
save the buildings of the rich and targeting the poor.
f. Internationally since elevated High ways have not solved but
created traffic problems, they are being demolished.
The Issues regarding Coastal Elevated Highway:
1. There was no public consultation
2. The project is in violation of CRZ notification.
3. The coastal fisher people of Chennai are the original
inhabitants and they provide the protein rich fish to the people of
Chennai and their displacement is tantamount to the denial of their
customary rights.
4. Already, the Chennai coastal fisher and other unorganized
worker families, affected by Tsunami, with loss of lives, housing and
tools and belongings, have not been rehabilitated in terms of housing
and proposed displacement to far off places would be a second Tsunami,
depriving them of livelihoods and education.
5. The longest beach in India, Marina and its eco - system would
be affected by this Project. The nesting of Olive Ridley turtles in
the Marina would be hampered by this Project
6. The CRZ violations by the vested interests have not been
checked by the State Govt., which has ignored the Union Government's
suggestion that Chennai coast should be classified as CRZ I in stead
of CRZ II
7. The green lungs of Chennai and historic and cultural
heritage centres, namely, Theosophical Society and Kalakshetra and
their environment would be affected.
River Cleaning Project
There are several waterways existing in Chennai city like
Adyar, Buckingham Canal, Mambalam Canal, Ottery Nullah, Captain Cotton
Canal etc. In the name of cleaning these water ways, Govt had already
wasted large sum of money, but studies have shown that the pollution
of the waterways is due to the letting in of untreated sewage by
Government Agencies. During the Paadayatras held in 1999 and 2008,
Chief Minister promised of upgradation of huts, constructing
protective walls and schools for the children but all these promises
have gone in vain.
Our Demands:
a) Immediately call for an end to all evictions of
slum dwellers.
b) If evictions are required, insist on the right of
people to be resettled within 3 kilometers of
their homes.
c) Call for Public Consultations on the
Port-Maduravoyal Elevated Expressway and the
Cleaning of Water ways as well as Coastal Elevated Highway
Project to evaluate people's
needs and people's priorities.
d) Provision of Patta, basic amenities and fire proof
housing for slum dwellers who have lived
for over 10 years.
e) Provision of 1 cent of land for housing homeless
unorganised workers in Chennai City by
using surplus lands already acquired under Urban Land
Ceiling Act, Panchami Lands, Corporation and Government Lands.
f) Ownership title to residents of TamilNadu Slum
Clearance Board tenements who have
lived for over 10 years.
