Dalit woman draws water from well in upper caste area, thrashed
Kendrapara (Odisha): A Dalit woman was allegedly beaten up by members of upper caste for drawing potable water from a government-dug deep tube well in their area at a village in Odisha's Kendrapara district, police said today.
The woman faced the wrath of upper caste groups in Pikirali village, about 25 Km from here, on Monday as lower caste groups are not allowed to draw water from these wells, they said.
About 10 dalit families of the village were depending on one tubewell in their locality. But since last month, the sole tubewell in Dalit Sahi was defunct and scheduled caste persons were forced to subsist on polluted water of a pond.
Driven by compulsion, a Dalit woman Kalpana Sethi (25) decided to fetch water from a tubewell in front of the house of an upper caste person, Bhamara Jena, for which some upper caste persons assaulted her and took away her bucket, police said.
The woman yesterday filed an FIR against Bhamara, Umakanta Jena and Kishor Jena (all belonging to the upper caste) in the local police station and alleged that they hurled abusive language and assaulted her for drawing water from the village tubewell.
The woman also alleged that some influential upper caste persons have been preventing the Dalits, including women and children, to take water from the village tubewell.
Earlier also, upper caste members abused some dalits for using the tubewell to draw water but the frightened people did not lodge any FIR against them, Sethi claimed.
"Acting on the FIR lodged by the complainant, cases under sections 354, 294, 341, 506 of IPC and section 3 of SC and ST (atrocity prevention) Act have been registered against persons named in the FIR. The matter is being investigated," said Kendrapara Sub-Divisional Police Officer (SDPO) Nrusingh Charana Swain.

Four gets 10 years jail for attacking dalit family
AJMER: The court here on Wednesday sentenced four accused to 10 years imprisonment in an attempt to murder case. The men were found guilty of attacking a dalit family in Panner village of Roopangarh block. The court also imposed a fine of Rs 10,000 on the accused.
According to the prosecution, Tilakraj, Inshwar, Prabhuram and Badami destroyed the house of one Om Prakash Banwari near the bus stand of Roopangarh in August 2008. They also attacked the family with axes and sticks in which Om Prakash, his wife Sampati and one Madan Lal were injured.
The prosecution produced witnesses for proving the crime.

Dalit employee commits suicide due to harassment by colleagues
Ahmedabad: A dalit government employee in Ahmedabad allegedly committed suicide due to harassment and humiliation by his colleagues, police said here yesterday.
Naresh Chavda, a clerk in the Industries Commissionerate at Udyog Bhavan in Gandhinagar, consumed pesticide yesterday.
His family members rushed him to Gandhinagar Civil Hospital where he was declared brought dead, they said.
His family members protested outside the hospital after the postmortem and refused to take his body until police registered a case of abetment of suicide against three Udyog Bhavan employees.
The DySP of the SC-ST cell, which was handed over the probe in the case, today questioned the general manager of the division and two other employees.
Police said family members of the deceased had accused them of harassing and insulting Chavda to such an extent that he had thought about quitting his job.
"We are probing the case from all angles.
We went to the office to question the general manager and two other employees to gather clues. We have taken their statements and are conducting a detailed probe," DySP M B Joshi said.

Reservation: Why?
Reservation based on economic criteria? Or other criteria are also equally important. Here are some of my views why we need to consider the latter.
An economic criterion is the foremost necessity. However, it is the necessary and not the sufficient condition.
In a country as India, other factors like, educational condition of the region, Access to social and physical infrastructure (mass media, health care, educational institutions, cultural specifics), access to bank and financial institutions/credit play a vital role.
Census 2011 has not yet given the data on OBC, NSSO (2004-05) 61st round came up with the 41% (creamy & non creamy), Census 2011 SC represents 16.2%, ST 8.2 %, together its 24.4% of the Indian population.
Approximately if one take the NSSO OBC data and Census SC & ST together it represents 65.4%. Accordingly the Supreme Court keeping the spirit of the Indian Constitution, reservation set under SC is 15%, ST 7.5%, OBC-27%, altogether it constitutes 49.5%. Even if the creamy layer for OBC is taken to be 15%, total reservation and the compared with population representation still is fair enough to be considered. The Mandal and the National commission for OBC have undertaken the case for OBC, because majority of this section is Socially & Economically Backward Classes (SEBC).
OBC and creamy layer is the vintage point where 'economic issue' for reservation comes into plight. Looking into the Annual report of Ministry of Social & Justice and Empowerment 2011- 2012, Cleary suggest the exclusion of these groups from non- creamy layer status:
I. Constitutional Posts II. Service Category III. Armed Forces including Para-Military Forces IV. Professional Class and those engaged in Trade and Industry V. Property owner, and VI. Income/Wealth Tax payee
"The children of persons engaged in trade, industry and professions such as a doctor, lawyer, chartered accountant, income tax consultant, financial or management consultant, dental surgeon, engineer, architect, computer specialist, film artists and other film professional, author, playwright, sports person, sports professional, media professional or any other vocations of like status whose annual income is more than 6,00,000 for a period of three consecutive years... belong to the creamy layer and so are also excluded from being categorised as "socially and educationally backward" regardless of their social/educational backwardness." – National Commission for Backward Classes/ SC statement
This is clear that policy have taken due consideration of catering to specific needs of the deserving candidates. Further discrepancies at the ground level reality are a case specific issue attributable to corruption etc… and should not be generalised to the entire spectrum of this group.
The importance of other factors
When more than half of the population is under the reserved category and the representation is below that, there has to be a question why these people is under represented. Service sector jobs reservations since initiated are as new as liberalisation policy In India (taking into Rajiv's major move of 1985). It started in 1982 for SC/ST, and 1990 for OBC. When we are still debating the pros and cons of 1991 liberalisation, reservation policy is still too early to be conclusive, in the sense that it's still first generational phenomena. In educational institutes it was 1990 for SC/ST, and 2007 for OBCs. The National Commission for Backward Classes has also reserved 4.5% for linguistic minorities, which definitely caters the cultural specifics of such groups.
One needs to clearly take into affair the gestation factor in these cases. Policy on human life is not work done with brick and mortar, when done, its functional outcome is positively increasing and finally to a diminishing returns scale. Rather it increases at a low rate following a geometric progression. When a single human life is a complex composite of various issues, causal relationships and consequences, definitely, SEBC is a need based group of people collectively facing various such issues at the individual and societal level. A change at these dimensions is a long gestation project.
Arguments like, first, reservation affecting the pace of economic growth is obscured, the chief parameter for calculating growth is capital formation, this come not highly from the high income but chiefly from households of middle income groups and reservation provides mobility into middle class, and this is self-evident of the Indian scenario. Second, why some upper caste people want a backwards caste tag, according to me seems self- defeating, because the case here is not about identifying the need of the upper class, it about SEBC, if any group falls under the desired criteria s/he will get the benefit of OBC. Third, Also the Hindu- Muslim conversion argument and comparing state wise and religion (Muslim) to SC/ST is flawed, of the 41% OBC, Hindu comprised of 32%, 9% Muslim and others. One must not take a minor figure to support an argument.
I have focused much on OBCs rather than SC/ST because that has been the main course. Economic factor (income) alone is detrimental in the sense, only a few % of the people from the backward group can be fully covered under this factor holistically. Henceforth, looking into this as a systemic issue, under the present system, in spite of all its flaws reservation is still necessary.

Insulting person in absence not offence under SC/ST Act: HC
MUMBAI: Using abusive words or insulting a person belonging to scheduled caste or tribe in his/her absence does not amount to an offence under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, the Bombay high court has said.
Dismissing an appeal filed by one Mohanbhai Delkar, a 50-year old businessman from Silvassa, Justice A H Joshi said the insult or abuse has to be on the face of the victim 'viva voce' and in public view for it to be an offence.
Justice Joshi, in his August 26 ruling, said, "Such utterances may exhibit a feeling of contempt in the mind of the person who has become vocal. It may reflect his mind, notions and feelings, harbouring contempt and discourtesy, bout would not render such person, ipso facto an offender, under the provisions of the said Act."
Delkar had moved the high court early this year, challenging a special court's order acquitting one Bharat Patel, also a businessman from Silvassa. - Rosy Sequeira

Dalit woman found murdered, husband blames victim's cousin
CHANDIGARH: A dalit woman, who was in her mid-20s, was found murdered at her house in a residential colony of Julana town of Jind district on Wednesday afternoon.
With the blood oozing out of her throat, alleged slit by a sharp-edged weapon, Manju's dead body was lying on the bed. Manju's one-and-half year-old son was sleeping nearby.
The incident came to light when her husband Ajit, who works as mason reached home in the lunch time. He informed the landlord who further informed the police control room.
Meanwhile, senior officials of the police department including the Jind SP B S Rana and crime team were rushed to the spot. Manju's body was sent to the Jind hospital for autopsy.
In his complaint to police, Ajit suspected the involvement of Manju's cousin Sonu into the incident. In his complaint to the police, Ajit informed that the family did not had good relation with Sonu as he had been opposing the marriage.
Police has also not ruled out the possibility of honour killing into the incident. We are verifying the contents of complaint lodged by Ajit. We are waiting for the postmortem report as well as reports of scene of crime team and forensic examination unit. Meanwhile, we have send police parties to round up Sonu for the further investigations,'' police officials said.

Dalit samiti seeks internal quota for SCs
Activists of the Karnataka Dalitha Sangharsha Samiti (DSS) staged a protest here on Wednesday for the fulfilment of their demands.
Addressing the protest meet, convener of DSS M. Gurumurthy expressed displeasure against the delay in implementing the recommendations of Justice Sadashiva panel on providing internal reservation to Scheduled Castes. The panel has prepared its report after assessing the socio-economic position of various communities that were classified as scheduled castes. The implementation of the recommendations will ensure access to education and employment to social groups that were subjected to inhuman practices such as untouchability, he said.
He said in many villages in Shimoga taluk, families belonging to Scheduled Castes found it difficult to cremate the dead.
The land used by Scheduled Castes for cremation was encroached by influential persons. The government should allot land to Scheduled Castes in every village for cremation, he said.
He pressed for the installation of a bronze idol of Dr. Ambedkar near DC's office and for the establishment of a study chair in memory of B. Krishnappa at Kuvempu University.
