HIGH COURT COMES TO RESCUE OF THE SCHOOL STUDENTS  Delhi High Court (Justice Rajiv Sahai Endlaw) today directed Prabhu Dayal Public School to permit Aditya Sharma, Class IX student and Aditi Sharma, Class XII student to appear in the annual exams scheduled to be held from 01.03.2011. The father who is physically handicapped earns Rs.3500/- per month and was unable to pay school fees for the year 2010-2011. The father had been requesting the school to treat his wards under Economically Weaker Section and grant them freeship but the school was not accepting his request and insisting for full school fees.  The Hon'ble Judge was hearing a petition filed by Aditya Sharma and Aditi Sharma through Advocate Ashok Agarwal contending that the action of the school in not permitted the students to appear in the examinations is unconstitutional, illegal, arbitrary, violative of right to education guaranteed to the students under Articles 14 (right to equality), 21 (right to life with dignity) and 38 (right to social justice) of the Constitution of India, contrary to the provisions of Delhi School Education Act, 1973 and tantamount to commercialization of education which is impermissible in law.   The Hon'ble Judge was pleased to issue notices to the school and the Director of Education, Government of Delhi to reply to the petition by May 09, 2011.
