again plain cloth police visit MASUM office

Kolkata Police instituted Taltolla P.S case no.134/2008 dated 9.6.2008 under
sections120(B)/170/229 of IPC against Mr. Kirity Roy, the then President,
Banglar Manabadhikar Suraksha Mancha (Masum) and others for organising
Peoples Tribunal on Torture on 9th and 10th June 2008 at Kolkata out of
grudge and to gag the voice of human right defenders. The police abused to
continue in exercising its power by organising a raid on 12.6.2008 at the
office of Masum at 26, Guitendal Lane, Howrah by ransacking it for several
hours. They seized number of documents from the office.



On 18.9.2008, we filed a *Writ Petition 25022(W)/ 2008 Kirity Roy VS State
of West Bengal & others* before Hon'ble High Court, Calcutta challenging the
authority of police to institute the said case making Commissioner of
Police, Kolkata, the State of West Bengal and others parties to the said
proceeding.



The filing Writ Petition before the Hon'ble High Court has possibly
infuriated Kolkata Police while copy of the Writ Petition was served upon
the Commissioner of Police. To counter blast the proceeding before High
Court, Kolkata Police, so far in the meantime lying low in following the
police case after the search in Masum's office, jumped up into the action in
a vindictive manner and as a result*, today i.e. on 27.9.2008 at about 4
p.m. a police team comprising Mr. Biplab Chakrabarty, Sub Inspector, Mr.
Sankar Datta, Sub Inspector, Mr. H.K. Roy, Assistant Sub Inspector of
Kolkata Police, Detective Department, Lalbazar, Kolkata entered into Masum's
office in plain clothes*. They searched for Mr. Kirity Roy and were bent
upon for him when he was absent in the office. The police team ultimately
served one notice under section 91 of Cr. P. C. asking us to produce three
documents to Mr. S. Dhar, Detective Department, Kolkata in connection with
already instituted Taltolla police case no. 134/2008 on 1.10.2008 in his
office at Lalbazar, Kolkata. The documents asked by the police are related
to three victims of police torture, who sworn affidavits for Peoples
Tribunal on Torture.



We severely condemn Kolkata Police for renewing its vigour in proceeding the
criminal case against us and we see the incident as an another onslaught on
the ongoing human rights movement in West Bengal under the back drop of
ruthless violation of human right at Nandigram by Left front Government. The
action of police is per se illegal, authoritative and direct interference in
judicial process and justice delivery system while the entire matter is
sub-judice before Hon'ble High Court, Calcutta and as copies of the Writ
Petition have already been served on Kolkata Police. We demand immediate
withdrawal of the notice served by the police team today.
