Subject: [Impeach Bush] Get Ready To React: Tuesday is Prop H8 Marriage Ruling Day of Decision 5-26
The California Supreme Court will rule on the challenge to Proposition 8 on Tuesday. Forthcoming CA Supreme Court Opinion Filings posted here:
DAY OF DECISION ACTIONS
TUESDAY NIGHT!!We have just learned that the California Supreme Court will announce its decision on Proposition 8 Tuesday, May 26th. If it follows past practice, the court will make its announcement at about 10 AM Pacific Time (1 PM, Eastern / 12 noon Central).
Depending on what the court decides, we will either PROTEST or CELEBRATE
We will PROTEST if:
-- The court upholds Prop 8, and invalidates the 18,000 same-sex marriage licenses that California already issued;
or,
-- The court upholds Prop 8, but upholds the 18,000 same-sex marriages already performed, which would be a cruel, but phyrric victory for equality.
We will CELEBRATE if:
-- The court rejects Proposition 8 and says that same-sex couples are entitled to the marriage rights that heterosexual couples already have.
So call, email, Facebook, Twitter your friends – DAY OF DECISION actions are TUESDAY NIGHT!

California Supreme Court to rule on Proposition 8 Tuesday
The California Supreme Court announced today that it will rule Tuesday on the constitutionality of Proposition 8, the November ballot measure that resurrected a ban on same-sex marriage. The ruling, which will be posted at 10 a.m., will also determine whether an estimated 18,000 same-sex marriages will continue to be recognized by the state. Gay rights lawyers have argued that the ballot measure was an illegal constitutional revision rather than a more limited amendment. Atty. Gen. Jerry Brown urged the court to reject the measure on different grounds. He contended the proposition was unconstitutional because it took away an inalienable right without compelling justification. Chief Justice Ronald M. George and Justice Joyce L. Kennard will cast key votes in the case. They were part of the four-judge majority that gave gays the right to marry last May, but both indicated at oral argument that they were not persuaded the measure was unconstitutional. The court's majority decision should be revealed in the first or second page of the ruling and reiterated in its last paragraph. Separate concurring and dissenting opinions follow. Counting votes may be tricky because the court is dealing with three different legal issues: the revision challenge, the attorney general's challenge and the fate of existing same-sex marriages. The court's vote on whether Proposition 8 is an impermissible revision, for example, will probably differ from its vote on whether existing marriages should continue to be recognized by the state. Justices who disagree with the majority file dissents. If they agree with only part of the majority decision, they file an opinion called a partial concurrence and dissent. During oral argument in March, every justice expressed support for upholding existing marriages. Justice Carlos M. Moreno indicated he believed Proposition 8 was an illegal revision, indicating he would dissent on that question Moreno might be joined by Justice Kathryn Mickle Werdegar, a former civil rights lawyer who stressed the court was dealing with a novel legal question. Werdegar, however, did not join Moreno in voting to put the measure on hold pending the court's ruling.
"Decision Day" is on Tuesday!
The California Supreme Court just announced that it will release its decision on the fate of Proposition 8 on Tuesday, May 26.
The court will either uphold the Constitution, recognizing equal protection under the law, or uphold discrimination, taking away fundamental civil rights from a minority.
This will be a moment that you -- and your friends -- will remember for the rest of your life. We don't know what the state Supreme Court will do. But we'll send you the news as soon as it is announced.
Do you know someone who wants to hear this historic news as soon as the Supreme Court releases it? Then forward your friends this message right now and ask them to sign up for a "Decision Day" email alert at:

As Charlize Theron told the Courage Campaign community a few weeks ago, Fresno will be the most important place to be on the Saturday after Decision Day -- no matter what the Supreme Court rules.
At 1 p.m. on Saturday, May 30, thousands of marriage equality supporters from across California -- LGBT and straight allies alike -- will "Meet in the Middle for Equality" to celebrate or protest the Supreme Court's ruling at Fresno City Hall.
Nearly 100 organizations, including the Courage Campaign, are mobilizing members for this amazing event in the heartland of California. "Equality Express" buses are leaving from several locations across the state. If you don't already have a spot reserved, think about car pooling with your friends to Fresno.
If you have friends who want to hear the Supreme Court decision as well as more information on Meet in the Middle, please forward this message right now and ask your friends to sign up for email alerts today:
