Washington State Attorney General:
Â
Our office has been retained by a husband and wife who
previously petitioned for relief from the U.S. Bankruptcy Court in Spokane,
Washington State.
Â
That litigation recently resulted in the filing and service of a
DECLARATION OF
INSOLVENCY by the United States appearing ex rel. as Interpleader. A
hard copy is attached, and a fully hyperlinked version is also here on the

To satisfy due diligence, my office attempted to obtain
information identifying the Registered Agent for service of process on the Federal Reserve Bank of San Francisco, with
branch offices in Seattle.
Â
However, the Washington State Secretary of State informed us via
email that the Federal Reserve Banks are not registered with them as foreign
corporations, even though the Ninth Circuit has held that Federal Reserve Banks
are “privately owned and locally controlled corporations.� See Lewis v. United States, 680
F.2d 1239 (1982).
Â
Briefly, Mr. Lewis was hit by a Federal Reserve vehicle in Los
Angeles, and he sued the United States (Federal
Government) to recover the resulting damages under the Federal Tort Claims Act. The Ninth Circuit held that Lewis sued the
wrong party, however, because the Federal Reserve Banks are not Federal
agencies for purposes of that Act. The
Ninth Circuit then went into some detail itemizing all of the reasons why those
Banks are not Federal agencies.
Â
Because Lewis supra
is now binding case law within the entire Ninth Circuit, we argue that the Federal Reserve Bank of San Francisco should
register as a foreign corporation with the Office of the Washington
State Secretary of State, due to its substantial business presence here.
We also argue that, as a foreign corporation, the Federal Reserve Bank of San Francisco should
display a proper identifying suffix such as “Inc.� or “Corp.� in all written
occurrences of that proper entity name.Â
Even though a Federal corporation was originally created by Act of
Congress, it is not thereby exempted from obeying all applicable Washington
State constitutional provisions, statutes and regulations.

On this point, please see also Daly v. The National Life
Insurance Company of the United States of America, in which the Indiana
Supreme Court held in the year 1878 A.D.
as follows:

"Foreign
Corporation" Defined. -- The statutes of this State define a foreign
corporation to be "a corporation created by or under the laws of any other
state, government, or country," or one "not incorporated or organized
in this State".

Company Created by Act of Congress. -- An insurance company created by an
act of Congress is a foreign corporation subject to the requirements of the statute
of this State approved June 17th, 1852, "respecting foreign corporations
and their agents in this State."Â 1

as a Local Legislature. -- Constitutional Law. -- An act of Congress
creating a private corporation is the act of Congress as the local Legislature
of the District of Columbia;Â as Congress can not, under the federal
constitution, as the Congress of the United States, create a private

The Tenth
Amendment clarifies these holdings quite neatly:Â to create a Federal corporation that is national in scope would thereby invade
States’ Rights to charter their own domestic corporations. Thus, Congress can only create a Federal
corporation, like the Federal Reserve Banks and the Union Pacific Railroad
Company, when it enacts municipal law in its capacity as the Legislature
for the federal zone:

* 17 May 2009 Donald Rumsfeld, the former US defence secretary, provided
George W Bush with top secret intelligence briefings on the Iraq war that
featured cover pages adorned with Biblical quotes. According to a

*GQ* magazine the religious texts were imposed over pictures of the US armed
forces engaged in the war.

Sends Mueller, Ashcroft Lawsuit Back
*18 May 2009 The Supreme Court ruled today that former attorney general John
Ashcroft and FBI Director Robert Mueller may not be sued by Arab Muslims who
were seized in this country after the 2001 terrorist attacks and allege
harsh treatment because of their religion and ethnicity. The court ruled 5
to 4 that the top officials are not liable for the actions of their
subordinates absent evidence that they ordered the allegedly discriminatory
activity. Javaid Iqbal was held in solitary confinement in a section of a
Brooklyn prison known as Admax-Shu, for "administrative maximum special
housing unit," where he said he was subjected to numerous beatings and strip
searches.

Cheney Grabs a Third Term

WASHINGTON
Dick and Rummy are at Cafe Milano in Georgetown, holding court. The maître
dÂ' fawns. Waiters hover. Tourists snap pics on their digital cameras. Cable
chatterers stop by to ingratiate themselves.
It isnÂ't so much that Dick and Rummy are back. ItÂ's that they never left.
They had no intention of turning AmericaÂ's national security over to the Boy
Wonder. The two best infighters in Washington history werenÂ't yielding turf
to a bunch of peach-fuzz pinkos who side with terrorists.
Let W. work out at the S.M.U. gym in Dallas, waiting for history to redeem
him; Dick and Rummy are leaning forward into history, as they always do.
Cheney is tawny with TV makeup; thereÂ's no point taking it off. The gigs are
nonstop, and he has a big Obama-bashing speech Thursday at the American
Enterprise Institute.
Â"That was funny when you were on Fox and Neil Cavuto called you ObamaÂ's
Â'ball and Cheney,Â' Â" Rummy grins, taking a gulp of his brunello.
Dick grunts, raising a fork of his Risotto Gucci with roasted free-range
quail.
Â"The punks thought they could roll over us,Â" Vice mutters. Â"Nobody puts Baby
in a corner.Â"
Eyeing the quail, Rummy shakes his head. Â"Can you believe the nerve of that
dadburn whippersnapper at the press dinner, saying your memoir would be
called Â'How to Shoot Friends and Interrogate People?Â' Whatever happened to
the great White House tradition of giving respect to your predecessors?Â"
Dick is looking over at himself on the TV behind the bar, where Fox is doing
a segment about how Republicans on the Sunday talk shows praised him for his
shock-and-awe campaign against Obama.
Â"I canÂ't believe how easy it was to bring Obama into line,Â" Rummy says,
gnawing on Gorgonzola. Â"We wouldnÂ't have needed waterboarding if everybody
cracked like a peanut. It was even easier than getting the bit into JuniorÂ's
mouth. Way simpler than if weÂ'd had to contend with McCain. In the end, the
right guy won.Â"
Dick is surprised, too, but who can tell?
Â"YouÂ're running national security now and everyone knows it,Â" Rummy says.
Â"You got Obama to do an about-face on the torture photos. HeÂ's using our old
line about how it would endanger the troops. HeÂ's keeping our military
tribunals. His Justice Department invoked our state secrets privilege to try
to get that lawsuit on torture and rendition dismissed. HeÂ's trying to stop
any sort of truth commission, thank goodness. HeÂ's got his own surge going
in Afghanistan. HeÂ's withdrawing from Iraq more slowly. HeÂ's extended our
secret incursions over the Afghan border into Pakistan.Â"
Dick smiles on one side of his face.
Â"Transparency bites,Â" he snarls.
Â"By golly, yes,Â" Rummy says. Â"We controlled Junior by playing on his fear of
looking like a wimp just as his dad did. And now weÂ're controlling Boy
Wonder by playing on his eagerness to show that the Democrats are tough on
national security. HeÂ's a sucker for four-star generals, canÂ't resist anyone
in uniform. Petraeus and Odierno speak and he jumps. If we want to roll him,
we just send in the military brass flashing their medals.Â"
Rummy knocks back some more brunello, and shoos away some Japanese tourists
after confiscating their cameras.
Â"I hear Poppy Bush is furious at you,Â" he says. Â"HeÂ's telling folks he put
Junior in your care and you stole his presidency and destroyed the Bush name
and derailed JebÂ's chances to ever be president, and P.S., you wrecked the
country and the Atlantic alliance to boot. He has it in for Lynne, too.
Thinks she spun you up, like she did in high school with her flaming batons.
He thinks you got loopy from all the heart procedures. And ColinÂ's mad at
you.Â"
Â"He can go to yoga with Pelosi for all I care,Â" Dick growls.
The two old connivers clink glasses. Â"So,Â" Rummy muses, Â"what do we make our
new White House boy toy do next?Â"
Â"Well,Â" Dick says. Â"HeÂ's got to keep Gitmo open. ItÂ's rich that his own
party wonÂ't give him the money to close it. The NIMBY factor works every
time — no terrorists in my backyard. HeÂ's got to stop this pansy diplomacy
with Muslim nations. HeÂ's got to let Bibi take out those Iranian
centrifuges. HeÂ's got to stop his Kodak moments and Commie book club with
Hugo Chávez. HeÂ's got to release those C.I.A. memos proving that we were
right to rip up the Constitution. And, of course, heÂ's got to pardon
Scooter.Â"
Â"Can we get him to do all that, Dick?Â"
Dick twinkles. Â"Yes, we can.Â"
